The extradition hearing for suspended Deputy Commissioner of Police (DCP) Abba Kyari has been postponed until April 27.
After the Attorney General of the Federation (AGF) and Minister of Justice, Abubakar Malami (SAN), failed to serve Kyari with the extradition application, Justice Inyang Ekwo of the Federal High Court in Abuja delayed the hearing.
Remember that the minister had requested Kyari’s extradition after the US government made a request in a multi-million dollar fraud case involving alleged fraudster Ramon Abba, alias Hushpuppi.
Malami told State House reporters that the application was still being processed after the Federal Executive Council meeting last week Wednesday.
On Wednesday, Kyari’s lawyer, Nureini Jimoh (SAN), informed the court that the AGF had not served his client with the extradition application that had been filed.
Pius Akutah, Counsel to the AGF and Head of the Federal Ministry of Justice’s Central Authority Unit (CAU), confirmed that the applicant has yet to serve the respondent.
Because of Kyari’s affiliation with the National Drug Law Enforcement Agency, Akutah stated the candidate couldn’t serve before today (NDLEA).
He promised the court that the applicant will serve the respondent (Kyari) by March 24 and requested an adjournment from the court.
Kyari’s lawyer did not object to the plea for adjournment but stated that he had 14 days from the date of service to make a response under the court’s regulations.
