Justice Chuka Obiozor of a Federal High Court in Lagos has fixed December 9, 2020, to entertain a suit seeking disqualification of Tokunbo Abiru, ca
ndidate of the All Progressives Congress in the forthcoming Lagos East Senatorial District bye-election.
The suit which was filed by candidate of the Peoples Democratic Party in the poll, Babatunde Gbadamosi, is also seeking the disqualification of the APC for fielding an ineligible candidate.
But Abiru and the APC have, through their lawyers, Abiodun Owonikoko, SAN, and Kemi Pinheiro, SAN, filed preliminary objections to the suit, asking the court to dismiss it for lack of jurisdiction.
Listed as defendants in the suit are Abiru, the APC and the Independent National Electoral Commission.
