On Thursday, a Chief Magistrates’ Court in Kaduna ordered the remand of Festus Luka, a 25-year-old farmer accused of murdering his uncle.
Luka, of Agatha Village in Kachia Local Government Area, Kadu, has been charged with culpable homicide.
The Chief Magistrate, Hajara Dauda, refused to hear Luka’s request for lack of jurisdiction.
He instructed the prosecutor to send the case file to the State Director of Public Prosecutions for legal advice.
Dauda postponed the case until February 24 for additional consideration.
Earlier, the Prosecutor, Insp Sunday Baba, told the court that the case was transferred from Katari Divisional Police Headquarters to the state CID for investigation on December 12, 2021.
Danjuma Maigona, a brother of the deceased, Hosea Maigona, reported the case to the Katari Police Station in Kachia LGA of Kaduna, according to Baba.
According to the prosecutor, the defendant and Hosea had a misunderstanding about the former’s wife, which resulted in an altercation.
Provoked by the statements about his wife, the defendant seized a cutlass and caused Hosea a serious cut on his hand before striking him multiple blows, resulting in the latter’s death on the scene, according to Baba.
He said that the offense violated Section 190 of the Kaduna State Penal Code, 2017.
