On Monday, Justice Inyang Ekwo of the Federal High Court in Abuja approved the appeal of Deputy Commissioner of Police Abba Kyari, the jailed former Commander of the Intelligence Response Team, Force Intelligence Bureau of the Nigerian Police Force.
InsightnaijaTV recalls that Kyari was detained by the police and is currently in the custody of the National Drug Law Enforcement Agency, NDLEA, for alleged drug trafficking participation.
The judge denied his release request but allowed him to meet medical personnel while giving his judgement on his bail application.
Kyari’s lawyer, Cynthia Ikenna, filed his bail plea last week on the grounds that he suffers from Hypertension and Diabetes, according to this magazine.
Kyari is hypertensive and diabetic, according to her, and cannot be controlled while in the NDLEA’s custody, she said, adding that her client was denied access to his own doctor. She also contended that the offences for which her client was charged were bailable, and that if bail was granted, he would not violate it.
Justice Ekwo declined to grant the bail application but said; “The only order I will make now is an order allowing the applicant access to any medical personnel of his choice. The court will wait for the expiration of the duration of the February 22 order of the court.”
The hearing on Kyari’s fundamental human rights enforcement suit was postponed to March 15, 2022, by Justice Ekwo.
