Intels Nigeria Ltd must continue to pay Chief Patrick Udoh, a retired employee, N1,233,180 ($3,000) as his monthly retirement money for the remainder of his life, according to the Port Harcourt division of Nigeria’s National Industrial Court.
This was revealed in a statement on the court’s official website issued on Friday.
Chief Udoh had requested the court’s discretion in his favor through his lawyer.
By presenting his exhibit, he claimed that he and the corporation had entered into a contract.
The court’s statement read that “From facts, the claimant- Chief Patrick Udoh had pleaded that he served the firm for about 20 years and was compulsorily retired from the services with a condition that his former boss would ensure that the firm would be paying him the sum of $3,000 (Three Thousand (US Dollars) monthly as long as the firm continues to be in operation in Nigeria.”
The firm, in response to his argument, claimed that the retired staff’s former boss penned the promise in his own handwriting.
in a personal role, with the intention of aiding him after he retires.
The firm also claimed that the undertaking was not legally binding on the company.
Justice Faustina Kola-Olalere, the presiding judge, decided that Chief Udoh had the right to the endeavor and financial advantages agreed upon.
Subsequently, the judge “ordered Intels Nigeria Ltd to pay compulsorily retired staff, Chief Patrick Udoh, the sum of $325,183.5 as retirement benefit from 2012 till September 2021 within 30 days.”
Kola-Olalere also ” directed the firm to continue to pay Chief Udoh the sum of $3000 monthly with effect from October 2021 as long as he’s alive and as long as the firm continues to operate in Nigeria.”
