Justice Obiora Egwuatu of the Federal High Court in Abuja on Monday,July 19, 2021 restrained the Zamfara State House of Assembly, the Chief Judge, and others from effecting the impeachment of the State’s Deputy Governor, Mahdi Gusau.
Justice Obiora Egwuatu gave the order on Monday, July 19, 2021 while delivering a ruling in an ex-parte motion with suit number FHC/ABJ/CS/650/2021 brought by the Peoples Democratic Party (PDP) through its lawyer, Ogwu Onoja.
Egwuatu, who ordered the defendants to maintain status quo pending the hearing and determination of the motion on notice, also stopped the house from impeaching its other members who are still in the PDP.
The judge gave the order after listening to Ogwu James Onoja (SAN), who moved a motion ex-parte to that effect, on behalf of the plaintiff in a suit filed in the name of the Peoples’ Democratic Party (PDP).
Onoja told the court that the House of Assembly and others were planning to impeach the Deputy Governor, who has refused to decamp to the All Progressives Congress (APC), adding it was of utmost urgency that the court intervenes by granting an interim restraining injection against the fifth to seventh defendants – the Speaker, Governor and Chief Judge).
